Patents

WHAT IS A PATENT?

It is a monopoly right to the exclusive use of an invention and can last for a maximum of 20 years. A patent is a property which, like any other business commodity, may be bought, sold, hired or licensed.

 

 

ARE ALL INVENTIONS PATENTABLE?

No. Broadly speaking, to be patentable an invention must be concerned with the composition, construction or manufacture of a substance, article or apparatus, or with an industrial type of process, as distinct from artistic creations, mathematical methods, business schemes or other purely mental acts. In addition, a few categories of invention are specifically excluded from patentability.

 

 

DO ANY FURTHER CONDITIONS HAVE TO BE SATISFIED?

Yes. An invention has to be new and not obvious to a person of ordinary skill experienced in the particular technology.

 

 

WHAT RIGHTS DO PATENTS BRING?

The exclusive right to use the invention or let others use it under terms agreed with the owner of the patent. Also the right to take legal action against others who might be infringing the invention and to claim damages. And the mere existence of a patent may be enough to deter a potential infringer. The Patent Office, however, does NOT take sides in any dispute.
