ВВЕДЕНИЕ

Главная цель обучения студентов иностранному языку в неязыковых вузах - это практическое овладение языком, то есть, умением и возможностью использовать в своей работе специальную литературу на иностранном языке и извлекать из нее необходимую информацию.

Заочная форма обучения предусматривает в первую очередь самостоятельную работу студентов. Как правило, студенты продолжают изучать тот же самый язык, который они учили в школе или в среднем учебном заведении.

Следует отметить, что студенты, поступающие на заочное отделение, имеют самый разный, зачастую низкий уровень языковой подготовки. В связи с этим, программа и контрольные работы по английскому языку включают в себя лексический и грамматический материал, необходимый для овладения навыками чтения литературы по специальности. Систематическая работа над материалом даст студентам возможность вспомнить пройденный ранее и изучить новый лексический и грамматический материал, а также повысить их социокультурный уровень.

В современных условиях повышения значимости фундаментальных наук в теоретической и профессиональной подготовке специалистов важное значение приобретает практическое владение иностранными языками. Оно является неотъемлемой частью современной подготовки специалистов высшими учебными заведениями.

Основной целью обучения студентов иностранному языку в неязыковом вузе является достижение ими практического владения этим языком, что предполагает при заочном обучении формирование умения самостоятельно читать иноязычную литературу по специальности вуза, с целью извлечения из нее необходимой для работы информации, переводить тексты на русский язык и беседовать на профессиональные темы.

Программа по английскому языку включает грамматический и лексический материал, необходимый для овладения умениями и навыками чтения литературы по специальности вуза и предусматривает, преимущественно, самостоятельную работу студентов.

Самостоятельная работа студента по изучению иностранного языка охватывает: заучивание слов английского языка, уяснение правил словообразования и грамматики, чтение текстов на английском языке в соответствии с правилами чтения, понимание текстов, построение вопросов и ответов к текстам, перевод предложений на русский язык (устный и письменный).

Перевод (устный и письменный) на протяжении всего курса обучения используется: а). как средство обучения; б). для контроля понимания прочитанного; в). В качестве возможного способа передачи полученной при чтении информации.

В условиях заочного обучения такие виды речевой деятельности как устная речь (говорение и аудирование) и письмо используются на протяжении всего курса как средство обучения.

Для того, чтобы достигнуть указанного в целевой установке уровня владения языком, следует систематически тренировать память заучиванием иноязычных слов, текстов, так как языковые навыки вырабатываются путем многократно выполняемых действий.

Данные контрольные задания для студентов 2 курса юридической специальности состоят из 5 текстов, объединенных единой темой, что обеспечивает многократную повторяемость лексического и грамматического материала и способствует более эффективному его усвоению студентами заочной формы обучения.

При изучении учебного материала необходимо соблюдать определенную последовательность в работе:

1). перед тем, как приступить к работе над контрольным заданием, необходимо овладеть произношением лексики данного текста. Текст вводит лексику, обеспечивающую беседу на определенную тему. Он не содержит трудностей и лишней на данном этапе информации;

2). изучение грамматических правил и выполнение упражнений к ним;

3). определение значения незнакомых слов по словарю;

4). перевод прочитанного предложения;

5). чтение вслух и перевод текста в целом;

6). краткое изложение содержания прочитанного текста.

 

Выполнение контрольных заданий и оформление контрольных работ

1. В течение года студент выполняет контрольные работы №3 и №4. Выполненные контрольные работы представляются на кафедру иностранных языков в соответствии со сроками, указанными деканатом. Кафедра прекращает прием контрольной работы №3 15 декабря, контрольной работы №4 – 15 мая.

2. Каждое контрольное задание в данном пособии предлагается в 5 вариантах. Вариант выбирается в соответствии с последними цифрами студенческого билета: студенты, шифр которых оканчивается на 1 или 2, выполняют вариант №1; на 3 или 4 - №2; на 5 или 6 №3; на 7 или 8 - №4; на 9 или 0 - №5.

3. Выполнять контрольные работы следует в отдельной тетради. На обложке напишите свою фамилию, специальность, номер контрольной работы и вариант.

4. Работы должны быть написаны аккуратно, четким почерком, в тетради в клетку следует писать через строчку. При выполнении работы оставляйте в тетради широкие поля для замечаний рецензента.

5. Контрольные работы должны быть выполнены в той последовательности, в которой они даны в данном пособии.

6. Каждое задание контрольной работы переписывается. Иностранный текст нужно переписывать на левой странице тетради, а на правой давать его русский перевод. Каждый абзац текста должен начинаться с красной строки.

7. Выполненные контрольные работы направляйте для проверки и рецензирования в университет в установленные сроки.

8. Если контрольная работа выполнена и оформлена не в соответствии с указаниями или не полностью, работа возвращается студенту без проверки.

9. Если контрольная работа не зачтена, то студент вновь переделывает всю работу и сдает ее на рецензию.

10. В случае несамостоятельного выполнения работы студент приглашается на устный зачет по контрольной работе.

11. Студент может выяснить все вопросы, возникающие при выполнении контрольного задания, в дни консультаций по расписанию заочного отделения.

 

Исправление работы на основе рецензии

По получении рецензии проверенной контрольной работы внимательно прочитайте рецензию, ознакомьтесь с замечаниями рецензента и проанализируйте отмеченные в работе ошибки.

Руководствуясь указаниями рецензента, повторите не вполне усвоенный вами учебный материал. Все предложения, в которых были обнаружены орфографические или грамматические ошибки или неточности, перепишите начисто в исправленном виде в конце контрольной работы.

Если рецензент потребует выполнить контрольную работу вновь, необходимо сделать это без задержки и сдать ее на повторную рецензию.

Отрецензированные контрольные работы являются учебными документами, контрольные работы необходимо сохранять, помня о том, что при сдаче зачета или экзамена опрос производится по контрольным работам.

После сдачи зачета контрольные работы отправляются на хранение в архив отдела кадров.

 

Подготовка к зачету

В процессе подготовки к зачетам рекомендуется:

- повторно прочитать и перевести тексты каждого контрольного задания, уметь беседовать

по темам, изученным за семестр;

- проанализировать по отрецензированным контрольным работам допущенные ошибки, уметь их объяснить;

- повторить соответствующие грамматические правила, проделать выборочно рекомендуемые учебным планом упражнения для самопроверки.

Зачеты проводятся в соответствии с учебным планом вуза. К устному зачету допускаются студенты, получившие по контрольной работе положительную оценку.

 

Студент обязан предъявить преподавателю, принимающему зачет по иностранному языку:

1). проверенные контрольные работы с рецензиями;

2). рабочую тетрадь с выполненными упражнениями и грамматическими правилами (согласно учебному плану);

3). Тетрадь – словарик к текстам, который состоит из активного словаря, транскрипции и русского перевода.

 

Для получения зачета студент должен:

1). знать тексты, грамматический и лексический материал, выполнить упражнения, рекомендуемые учебным планом;

2). уметь правильно читать, переводить без словаря и беседовать по проработанным за семестр темам, знать лексико-грамматический материал контрольных работ;

3). уметь прочитать и перевести без словаря новый текст на основе пройденной лексики.

CRIME AND THE LAW

Although one can certainly find slightly different definitions for crime, a legalistic view suggests that it is simply a violation of criminal law. There are four factors that must exist to classify the violation or omission of a rule as a crime:

1. It is assumed by political authority. The state assumes the role plaintiff or the party bringing forth charges. Murder, for example, is no longer just an offense against a person, but against the state.

2. It must be specific, defining both the offense as well as the prescribed punishment.

3. The law is uniformly applied. That is, equal punishment and fairness to all, irrespective of social position.

4. The law contains penal sanctions enforced by punishment administered by the state.

One type of crime is defined by legislative statute or statutory law. Crime additionally is determined on the basis of case law or common law. Case law is the use of judicial decisions from previous and similar adjudications to determine the outcome of a subsequent case. Hence, case law's determinations are significantly influenced by previous decisions called precedents.

Common law originated, and continues to be the main body of law in England. In early colonial America, residents were subject to the law handed down by English judges, and hence Common law. After American Revolution, the colonies in America adapted and changed the English law to fit their particular needs. In many states, legislatures standardized many common - law crimes such as murder, burglary, arson, and rape by putting them into statutory form or statutory law.

In other states extensive penal codes were passed thereby abrogating the common law crimes.

Beyond common law, statutory law, and case law, crimes are defined by administrative or regulatory law. Typically, regulatory laws administer civil privileges, such as the privilege to own a gun or drive a car and other licensed activities. Regulatory laws, however, may also encompass criminal charges. An example of a regulatory law that includes criminal charges would be mailing cocaine to someone, or a bartender selling alcohol to minors.

Criminal law can best be understood as defined by three basic elements. First, it prevents harm to society and its members. Second, it specifies what conduct is considered criminal. Third, it identifies prescribed sanctions for criminal conduct.

Usually, crimes committed in the United States are classified by the justice system as either felonies or misdemeanors. Felonies contain capital crimes - those crimes for which the death sentence may be imposed - as well as crimes for which the sentence includes imprisonment in a state prison for more than one (or in some states two) years. Misdemeanors are less serious crimes for which fines and shorter county jail time may be imposed. Usually, misdemeanors carry no more jail time than one year.

THE CLASSIFICATION OF THE LAW (USA)

The Common law and the Civil law. The term " common law" has several meanings. It is used to distinguish the law developed by the courts from that enacted by legislatures. The term is also used, probably in its largest sense, to distinguish between the English system of law and the civil or continental system of law. (to distinguish - различать).

The sources of the American common law for the most part are found in English law. The colonists were governed by charters granted by the King of England. These charters were general in their nature and left much to be worked out by the people of the colonies. Since most of the colonists were of English origin, they naturally were controlled by the customs of their mother country.

In Louisiana, and to some extent, in Texas and California, the civil law or the Roman law is the basis of the legal system, because these states were founded by French and Spanish colonists. The law of Continental Europe is based more directly upon the Roman law.

Public and Private law. Anglo-American law may be divided into two main divisions - public law and private law.

Public law is the law pertaining to the public as a whole, and may be divided into three general classes: (1) Constitutional law concerns itself with the powers to the federal and state government which are exercised through legislation and executive orders. The extent of the powers of Congress and state legislatures to pass laws and of the executives of the federal government and the states to issue orders involves questions of constitutional law. (2) Administrative law is concerned with officials, boards, and commissions created by legislative enactments for the purpose of carrying out legislative functions. (3) Criminal law consists of statutes and general maxims which forbid certain conduct as detrimental to the welfare of the state and provide punishment therefore.

Private law is all that body of law which pertains to the relationships between individuals as such in organized society. It may be classified as (1) the law of contracts, (2) the law of agency, (3) the law of real and personal property, (4) the law of business associations, (5) the law of procedure and practice and so on.

THE LEGAL SYSTEM

 

For all ordinary law and order each state has responsibility in its own territory. The federal courts - and hence the Federal Bureau of Investigation, federal police and prisons-are involved only in matters outside the individual states' jurisdiction (such as federal income tax) and in cases arising under the U.S. Constitution. This last category is the most interesting; if a person convicted by a state court system can produce evidence that the rights guaranteed by the U.S. Constitution were infringed by some aspect of his or her arrest, questioning or trial, a federal court can review that evidence and cither uphold the sentence or overturn it. So too with allegations of " cruel and unusual punishment" inflicted under the authority of a state.

Nearly all cases involving disputes about property or divorce, or murder, theft, assault or traffic offences great and small, are dealt with by the relevant state's hierarchy of city, county and state courts, police and prisons, in accordance with state law. Each state has a supreme court of appeal, but otherwise the systems vary.

The legal system is based on Common Law, brought across from England, and on the laws and ordinances passed by state legislatures and by other bodies to which state power has been delegated.

Anglo-American Common Law is based on the supposed reasonable person's view of what is right and fair. It has been likened to a wall, with bricks being added to it from time to time in the form of court decisions and notices stuck on it in the form of statutes. Each decision creates a precedent, and for any particular case a court must, as far as practicable, follow a precedent set by higher courts' previous decision. But most of the wall is by now covered with notices, specifically, statutes, etc.

Most, but not all, of the law in force is statute law, and the legislators have tried to ensure that the meaning of the statutes is quite clear. However, there is still plenty of scope for argument in courts about the application of statute or Common Law to particular cases, and an army of lawyers earn high fees for doing this work. States vary in the quality of legal help available for accused persons who have not the means to pay the fees themselves.

In some states judges are publicly elected, in others they are appointed by state governors or by special bodies such as judicial councils - though except at the lowest levels only lawyers are eligible for election or appointment. Some judges hold office for fixed periods, but others are installed for life or up to a retiring age; or there may be provision for " recall". Under this arrangement a group of people dissatisfied with a judge may collect signatures on a " recall" petition, and if the signatures reach the required number the people of the state (or county) vote " yes" or " no" to the question whether the impugned judge should he confirmed in office.

THE BASIC STRUCTURE OF

AMERICAN LAW ENFORCEMENT

Law enforcement may occur at a variety of governmental levels. It may occur at the county, state, federal, and even the international levels.

County Law Enforcement is represented by the sheriffs department. The functions of this department depend upon the region in which it is located. In the south, mid-and southwest, sheriffs departments often serve as the principal law enforcement agency in the area. In many smaller communities the sheriffs department also may be responsible for tax assessing and tax collection, patrolling the local bridges and highway extensions, serving as jail attendants and courtroom bailiffs, as well as executioners of both criminal and civil processes. Conversely, in the north­east the local sheriffs departments do little active law enforcement and considerably more of jail, courtroom and process - serving tasks.

The Department of Justice The US Department of Justice is sometimes called the legal arm of the government. The Department of Justice is headed by the attorney general, who is empowered to enforce federal law, represent the US government in federal court actions, and to conduct law enforcement investigations.

The U.S. Marshals Service was established in 1969, in 1974 it-was elevated to the status of a federal bureau.

Contemporary marshals focus their energies principally toward servicing the federal court system. First, they service the civil and criminal process and execution of arrest warrants. Second, they transport and protect federal prisoners and witnesses and, finally, U.S. marshals provide security for federal court premises and personnel (judges and juries).

The Federal Bureau of Investigation. Established in 1908 the Federal Bureau of Investigation remains among the most respected and efficient law enforcement agencies in the world. Ironically, the FBI is not really a police agency. The central function of the FBI is investigative. The jurisdiction of this agency extends to all areas and matters that pertain to the United States as an interested party. These matters include violations of federal laws and statutes, espionage, sabotage, treason, violation of federal civil rights acts, robbery of federally insured banks, kidnapping, and interstate transportation of contraband such as drugs, explosives, governmental secrets, or stolen properly. The FBI additionally provides a nationally accessible forensic laboratory, specialized training courses and certification programs.

The Drug Enforcement administration known as the Bureau of Narcotics and Dangerous Drugs, is responsible for enforcement all federal drug legislation.

The Secret Service is actively involved in the protection of political figures and visiting dignitaries. In 1989, a unit of uniformed Secret Service officers was assigned to patrol and protect the White House and the president of the United States. CRIME AND PUNISHMENT

 

America's notoriety for crime is well-founded. The outlawing of alcohol in 1919-33, known as the period of " Prohibition", encouraged the growth of a huge network of corruption and blackmail and gang rivalry, and when Prohibition ended, the network of organized crime that it had fostered turned to other types of activity - nowadays based on drugs as well as ordinary large-scale robbery. In Hollywood's version the big men of crime are confident men of power and wealth. In real life today their empire runs from big-time robbery and drug dealing through exploitation of permitted gambling in Nevada and Atlantic City to legitimate business Financed by illicit gains. As visitors to Las Vegas walk among the cascading lights outside the gambling halls they may admire the marvelous offensive and defensive armaments of Al Capone's ancient bullet-proof car, now in a miniature street-side museum and serving as a reminder of the origins of the gambling halls.

But the crimes that worry most ordinary Americans are the more ordinary ones. Robbery and acts of violence have increased nearly tenfold in thirty years, in cities many people are afraid to go out at night. In New York, when an ordinary traveler in a subway train shot some robbers who were attacking passengers, and permanently injured one of them, he became a public hero and a huge campaign was mounted in his defence when he was taken to court. His acquittal in 1987 produced more joy than protest - though he was found guilty of a minor offence.

Although the perpetrators of most crimes arc not caught, the number of criminals who are convicted is great enough to crowd the prisons. In 1988 more that half a million people were in prison - more than twice as many as in any Western European country, in proportion to population. Nearly all these were in stale prisons.

Although each state has full responsibility for its prisons, the seventh amendment to the U.S. Constitution prohibits " cruel and unusual punishments", and if any evidence suggests that a state prison system may he breaking this rule an action against it may be brought in the federal courts. In a series of cases, federal courts have ruled that prisoners being held in overcrowded conditions are indeed being subjected to " cruel arid unusual punishment", and the logical consequence of these ruling was strict intervention by the federal courts in the operation of state prisons. By 1987 more than half the states were subject to court orders requiring them to improve conditions, and at least one line had been imposed for noncompliance. In nine states judges had appointed special administrators. Meanwhile (here was activity in building new prisons and expanding old ones, and some states were using private enterprise to cut their costs - claiming that such methods were successful. Thousands of prisoners were being released prematurely, and judges were being encouraged to try, as far as possible within reason, to avoid sentencing guilty people to imprisonment but to use alternatives, from community service to probation at home under close supervision. Some counties in New York State have used a new device, allowing people sentenced to imprisonment to stay in their homes for fixed periods instead, and providing them with electronic bracelets linked to a computer so as to monitor their movements. A home prisoner who breaks a personal curfew must go to jail.

How Laws are Passed

Nearly all important bills are introduced by the Government. About fifty bills are passed each year, some short, some long, some needing much discussion. Once the Government has decided to introduce a bill, a minister is put in charge of it. The preparation of the text may take many months, with long consultations involving civil servants in the minister’s department on the one hand and Parliamentary Counsel on the other.
At last the bill is ready to be submitted to Parliament. It will have to be passed by both Houses of Parliament, one after the other. It can begin its journey in either the House of Commons or the House of Lords, though all really important bills are in fact submitted to the House of Commons first.
The typical bill of moderate importance, then, will begin in the House of Commons. According to very ancient practice, it must have three “readings” there. The “first reading” is in effect merely an announcement that the bill is coming forward. Then after being in circulation for a reasonable length of time (usually one or two weeks at least) it goes to the ‘second reading”. This is the main debate on the general principles of the bill, and at the end of the debate a vote is taken. The important thing about this stage is not the final decision, but the words spoken in the debate, the arguments for and against, the discussion of principles and of details from many points of view.
After the bill has passed its second reading, a “standing committee” of up to forty-five MPs is set up to consider it in detail. The bill is printed in clauses and committee members may propose changes to the text. After the committee has finished with the bill, the next stage is called “the report stage”. The House itself now repeats the committee stage, though taking much less time. The House has before it the new text of the bill, incorporating the committee’s amendments. Some new amendments are proposed and there may be further discussion of the amendments which were proposed in committee but withdrawn so as to give the minister time to examine them thoroughly.
The last stage is the debate on the proposal to “read the bill a third time”. This debate is usually short. It is a final review and discussion of the
bill as it stands after amendment.
Next the bill must go through the same stages in the House of Lords. If the House of Lords rejects a bill which has been passed by the Commons, the bill can go no further for a few months; but if the Commons pass it again, in the same form as before, it must go to the Queen for her signature no matter what the Lords do. The Lords can merely delay bills which they don’t like.
A bill becomes an Act of Parliament when the Queen signs it.

Parliamentary Elections in Great Britain

Parliament is one of the most important parts of national life in Britain. You will also recall that the most important part of the Parliament is the House of Commons, the body composed of the elected representatives of Great Britain.
Elections to the House of Commons, known as parliamentary elections, form the basis of Britain’s democratic system. Unlike heads of Government in some countries, the Prime Minister is not directly elected by voters, although he or she is an elected Member of Parliament — an MP. Instead, The Prime Minister depends on the support of a majority of his or her fellow elected representatives in the House of Commons.
There are two types of elections, General Elections and By-Elections and of these the first is, naturally, the most important. In a General Election every seat throughout the whole country is usually contested, but a By- Election occasioned by the death or resignation of one particular member, is fought over one seat only. According to law, General Elections must be held at least every five years, although in very exceptional circumstances they may not take place so often (for example, during the Second World War).
Britain is divided into 650 parliamentary constituencies. Each constituency is a geographical area; the voters living within the area select one person to serve as a member of the House of Commons. The average number of electors in each constituency in England is about 70, 000; in other parts of Britain the average numbers are slightly lower.
The simple majority system of voting is used in parliamentary elections in Britain. This means that the candidate with the largest number of votes in each constituency is elected, although he or she may not necessarily have received more than half the votes cast. It is thought that this system favours a two-party system, particularly when the parties’ support is concentrated geographically, as in the case with the Conservative and Labour Parties. It does not favour parties whose support is spread across constituencies, such as the Liberal Democrats, as they tend to accumulate relatively small numbers of votes in each constituency and do not win many seats. Voting is by secret ballot.
All British citizens may vote if they are aged 18 years or over and are not legally barred from voting. Under recent legislation, British citizens living abroad may register to vote for up to 20 years after leaving Brit Voting in elections is voluntary. On average about 75 per cent of the electorate votes.
Any person aged 21 or over who is a British citizen, or citizen another Commonwealth country or the Irish Republic, may stand for elec40 to Parliament, providing they are not disqualified. Those disqualif include:
- people who are bankrupt;
- people sentenced to more than one year’s imprisonment;
- clergy of the Church of England, Church of Scotland, Church 0c Ireland and the Roman Catholic Church;
- members of the House of Lords; and
- a range of public servants and officials, specified by law. They include judges, civil servants, some local government officers, full-ttme members of the armed forces and police officers.
Candidates do not have to live in the constituencies for which t}ey stand. However, candidates who are on the electoral register in constituencies for which they are standing may vote in their constituencies. Candidates must be nominated on official nomination papr5, giving their full name and home address. The nomination paper must be signed by ten electors. At the same time a sum of 500 pounds must deposited on behalf of each candidate: candidates who receive less than cent of the votes cast in the election lose this deposit. Candidates from the main parties very rarely lose their deposits. Candidates normally belon o one of the main political parties. However, smaller political parties j groups also put forward candidates, and individuals without party sup0 also stand.
For the purposes of voting, each constituency is divided into a nunbe of polling districts. In each there is a polling station: many types of buildig, including schools, are used. The official expenses of parliamentary electic5 as opposed to individual candidates’ expenses, are paid by Government.

ВВЕДЕНИЕ

Главная цель обучения студентов иностранному языку в неязыковых вузах - это практическое овладение языком, то есть, умением и возможностью использовать в своей работе специальную литературу на иностранном языке и извлекать из нее необходимую информацию.

Заочная форма обучения предусматривает в первую очередь самостоятельную работу студентов. Как правило, студенты продолжают изучать тот же самый язык, который они учили в школе или в среднем учебном заведении.

Следует отметить, что студенты, поступающие на заочное отделение, имеют самый разный, зачастую низкий уровень языковой подготовки. В связи с этим, программа и контрольные работы по английскому языку включают в себя лексический и грамматический материал, необходимый для овладения навыками чтения литературы по специальности. Систематическая работа над материалом даст студентам возможность вспомнить пройденный ранее и изучить новый лексический и грамматический материал, а также повысить их социокультурный уровень.

В современных условиях повышения значимости фундаментальных наук в теоретической и профессиональной подготовке специалистов важное значение приобретает практическое владение иностранными языками. Оно является неотъемлемой частью современной подготовки специалистов высшими учебными заведениями.
